By accessing or using Kanbris, you agree to these Terms. If you do not agree, you may not use the service.

1. Service Description

Kanbris is a task management tool that:

• Integrates with Google Tasks API to view, create, modify, and sync task data
• Uses Google Drive API to store data and enable full app functionality
• Utilizes other Google APIs as necessary to provide complete app functionality
• Stores task data locally on your device for offline access
• Provides both free and paid (subscription-based) versions

2. Eligibility

• You must be at least 13 years old to use Kanbris
• By using Kanbris, you confirm that you have the legal capacity to enter into this agreement
• Business users must ensure that use of Kanbris complies with applicable company policies and local regulations

3. Accounts and Google Integration

• To use Google integration, you must connect your Google account
• By doing so, you authorize Kanbris to access and modify your Google Tasks data in accordance with the permissions you grant
• You are responsible for maintaining the security of your account credentials
• You can revoke access to your Google account at any time through your Google account settings

4. Data Storage and Privacy

• Kanbris stores your data locally on your device
• We also collect analytical data (e.g., crash reports, feature usage) to improve the application
• We do not sell personal data to third parties

5. Subscriptions and Payments

5.1 Free and Paid Versions

• The free version offers basic functionality
• The paid version is available via a monthly subscription
• Subscriptions are billed in advance

5.2 Pricing Changes

• We may change pricing or features with at least 30 days' prior notice
• Existing subscribers will be notified via email before any price increase takes effect

5.3 Right of Withdrawal (For Consumers in the EU)

Important for Consumer Users:

If you are a consumer (purchasing for personal use, not business), you have the right to withdraw from your subscription within 14 days of purchase without giving any reason, in accordance with EU Consumer Rights Directive and Polish Consumer Rights Act.

However, please note:

• If you request immediate access to the paid features and begin using the service within the 14-day withdrawal period, you expressly agree to the immediate performance of the contract
• By requesting immediate access, you acknowledge that you lose your right of withdrawal once you start using the paid features
• During the purchase process, you will be asked to confirm this agreement

If you withdraw from the contract, we will reimburse all payments received from you within 14 days of receiving your withdrawal notice.

5.4 Cancellation

• You may cancel your subscription at any time through your account settings or by contacting us
• Cancellation will take effect at the end of the current billing period
• No refunds will be provided for partial months, except as required by law or in accordance with Section 5.3

5.5 Business Users

If you are purchasing on behalf of a business, the right of withdrawal in Section 5.3 does not apply to you.

6. Acceptable Use

You agree not to:

• Use Kanbris for unlawful or harmful purposes
• Attempt to reverse engineer, decompile, or hack the application
• Abuse Google API integrations in violation of Google's terms
• Use the service to transmit malware, spam, or other harmful content
• Interfere with or disrupt the service or servers
• Violate any applicable laws or regulations

Violation of these terms may result in immediate termination of your access to Kanbris.

7. Intellectual Property

• All rights, title, and interest in Kanbris, including all software, designs, trademarks, and content, are owned by us or our licensors
• These Terms do not grant you any ownership rights to Kanbris
• You may not copy, modify, distribute, sell, or lease any part of the service without our express written permission
• "Kanbris" and related logos are trademarks or registered trademarks of DotWalker.com Maciej Fafula

8. Warranties and Disclaimers

8.1 For Business Users (B2B)

If you are using Kanbris for business purposes, the following applies:

• Kanbris is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not guarantee uninterrupted or error-free operation
• We are not liable for data loss, including tasks stored locally or synced with Google
• You assume full responsibility for backing up your data

8.2 For Consumer Users (B2C)

If you are a consumer using Kanbris for personal purposes:

• We will provide the service with reasonable care and skill
• The above "as is" disclaimer does not affect your statutory rights under EU and Polish consumer protection laws
• Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law

9. Limitation of Liability

9.1 For Business Users (B2B)

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, consequential, or special damages
• Our total liability for any claim related to Kanbris shall not exceed the amount you paid (if any) in the last 12 months

9.2 For Consumer Users (B2C)

If you are a consumer:

• Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud, or fraudulent misrepresentation
• Nothing in these Terms affects your statutory rights under applicable consumer protection laws
• We are liable for damages caused by our intentional misconduct or gross negligence

10. Termination

• You may stop using Kanbris at any time by deleting your account or discontinuing use
• We may suspend or terminate your access if you violate these Terms or misuse the service
• Upon termination, your right to use Kanbris will immediately cease
• Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply

11. Changes to Terms

• We may update these Terms from time to time
• The updated version will be published on our website at https://www.kanbris.com/terms
• We will notify you of material changes via email or through the application
• Continued use of Kanbris after changes means you accept the new Terms
• If you do not agree with the updated Terms, you should stop using the service

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Poland, without regard to its conflict of law provisions.

12.2 For Consumer Users - Online Dispute Resolution

If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution (ODR) platform:

12.3 Jurisdiction

• For business users: Any disputes shall be resolved before the competent courts of Wrocław, Poland
• For consumer users: You may bring proceedings in either the courts of Poland or the courts of the EU Member State where you reside, in accordance with applicable consumer protection laws

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of Kanbris.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

13.5 Language

These Terms are provided in English. If a translated version conflicts with the English version, the English version shall prevail, except where local consumer protection laws require otherwise.
